Content Policy & Takedown Procedures

1. Overview

Orbliq provides a platform for artists, photographers, and print sellers to visualize their own artwork in 3D and generate AI-powered showroom mockups. This Content Policy outlines the rules for user-uploaded content and the procedures for reporting copyright infringement or other content violations.

Orbliq acts as a hosting service provider within the meaning of § 10 DDG (Digitale-Dienste-Gesetz) and Article 14 of the EU Digital Services Act (DSA). We do not exercise editorial control over user-uploaded content.

2. User Content Ownership & Responsibility

2.1 Your Representations

By uploading any image or artwork to Orbliq, you represent and warrant that:

• You are the original creator of the content, or
• You hold a valid license, permission, or legal right to use and upload the content
• The content does not infringe upon any copyright, trademark, patent, trade secret, moral right, or other intellectual property or proprietary right of any third party
• You have obtained all necessary permissions from any identifiable persons depicted in the content
• The content complies with all applicable laws, including but not limited to German copyright law (Urheberrechtsgesetz – UrhG) and EU regulations

2.2 License to Orbliq

By uploading content, you grant Orbliq a limited, non-exclusive, revocable license solely to store, process, display, and transmit the content as necessary to provide our services (3D rendering, showroom generation, sharing features). We do not claim ownership of your content and do not use it for any purpose other than delivering the service to you.

2.3 Indemnification

You agree to indemnify, defend, and hold harmless Orbliq, its operators, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your uploaded content or its use
• Your violation of any third-party intellectual property rights
• Your violation of these policies or our Terms of Service
• Any third-party claim that your content caused damage to a third party

3. Prohibited Content

The following content is strictly prohibited on Orbliq:

• Copyright-infringing material – Any content you do not own or have permission to use, including reproductions of other artists' work, stock photos used without a license, screenshots of copyrighted media, etc.
• Trademark violations – Content that uses protected brand names, logos, or trademarks without authorization
• Illegal content – Content that violates German, EU, or international law
• Harmful or violent content – Imagery promoting violence, terrorism, self-harm, or illegal activities
• Explicit adult content – Pornographic or sexually explicit material
• Child exploitation material – Absolutely prohibited; will be reported to authorities
• Hate speech – Content promoting discrimination, hatred, or violence against individuals or groups based on protected characteristics
• Privacy violations – Content that reveals personal information or images of individuals without their consent
• Malicious content – Files containing malware, viruses, or other harmful code
• Fraudulent or deceptive content – Content intended to deceive, scam, or mislead others

4. Copyright Takedown Procedure

If you believe that content hosted on Orbliq infringes your copyright or other intellectual property rights, you may submit a takedown notice. We comply with applicable provisions of the EU Digital Services Act, German copyright law (UrhG), and the DMCA for international requests.

4.1 How to Submit a Takedown Notice

Send your takedown notice to: support@orbliq.com

Your notice must include:

1. Identification of the copyrighted work – A description or link to the original work you claim is being infringed
2. Identification of the infringing content – The URL(s) or sufficient information to locate the content on our platform
3. Your contact information – Full name, email address, phone number, and postal address
4. Statement of good faith – A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
5. Statement of accuracy – A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner
6. Signature – Your physical or electronic signature

4.2 Our Response

Upon receiving a valid takedown notice, we will:

1. Promptly review the notice for completeness
2. Remove or disable access to the allegedly infringing content
3. Notify the user who uploaded the content
4. Provide the user an opportunity to submit a counter-notification if they believe the takedown was made in error

4.3 Counter-Notification

If you believe your content was wrongly removed, you may submit a counter-notification to support@orbliq.com including:

1. Identification of the removed content and its former location
2. A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification
3. Your name, address, and phone number
4. Your consent to the jurisdiction of the courts in your district
5. Your physical or electronic signature

4.4 Repeat Infringers

Orbliq maintains a repeat infringer policy. Users who repeatedly upload infringing content will have their accounts suspended or permanently terminated. We track takedown notices per user account and may take action after:

• First offense: Content removal + written warning
• Second offense: Content removal + 30-day account restriction
• Third offense: Permanent account termination

5. AI-Generated Content

Our showroom mockup feature uses Google Gemini AI to generate room environments. Important considerations:

• AI-generated room environments are created for visualization purposes only
• The AI processes your uploaded artwork to place it in room scenes — you remain responsible for ensuring you have rights to the artwork
• AI outputs may inadvertently resemble existing copyrighted works — you are responsible for reviewing outputs before commercial use
• AI-generated backgrounds (rooms, furniture, decor) are not claimed as intellectual property by Orbliq
• Use of AI-generated content is additionally subject to Google's Generative AI terms of service

6. Reporting Content Violations

To report any content that violates this policy (not limited to copyright):

• Email: support@orbliq.com
• Include the URL of the content, a description of the violation, and your contact information
• We will investigate reports within 7 business days and take appropriate action

7. Enforcement

Orbliq reserves the right to:

• Remove any content that violates this policy without prior notice
• Suspend or terminate accounts that violate this policy
• Cooperate with law enforcement authorities when required by law
• Preserve content and user information when legally required
• Modify this policy at any time with notice to users
